a) The following individuals and their infants retired after April 11, 1899 shall be considered United States nationals from August 1, 1950 if they were resident on the Isle of Guam or any other area over which the United States has sovereignties::

Any person who is a native of Guam and lived in Guam on 11 April 1899, even those who were not on the Guam Islands on that day for a temporary period, who remained in Guam or any other area over which the United States exercised jurisdiction after that date, and who did not take positive action to obtain or obtain non-nationals.

Any person who is a citizen of the United States of America and who was or has been a citizen of Guam on or after April 11, 1899 (whether before or after August 1, 1950) is a citizen of the United States: Provided that, in the case of a person whose birth took place before 1 August 1950, he has not taken any positive action to obtain or obtain non-nationals.

Occasionally, and after such a statement has been made, such a person shall not be considered a US citizen under this section.
