I' m a former inhabitant of Guam, but I own real estate on the isle and still have interests and familiar origins there. I have a large compilation of newsletters, papers and fundamental papers on policy development in these areas and micronesia, as can be confirmed by Michael Lujan Bevacqua, Associate Prof. at the University of Guam.
For Bevacqua, I accept that the Guamese do not have intrinsic constitutional or any other kind of policy link with the United States. The Treaty of Paris, dated December 10, 1898, transferred Guam to the United States. The Treaty of Paris was handed over to Congress to define the citizens' sovereignty and the prospective state of Guam's population.
It respects agreements between two or more states. Guam also had a referendum in 1989 under the vigilant eye of a UN official to establish his privileged state. There is still the issue of Guam: Guam Balthazar J. Bordallo and Francisco B. Leon Guerrero sent to Washington, D.C. in the early 1930' s to apply for US nationalization.
The Congress granted the people of Guam American nationality under the name Organic of Guam, duly ratified by President Harry S. Truman on August 1, 1950. Guam, however, was not admitted as part of the United States. Guamians have the same privileges as Utah and other states as US nationals, with the exception of election to the electoral college.
A non-incorporated entity, Congress, under its authority over U.S. Supreme Court Insular cases and Section 3 of the U.S. Constitution, may make Guam's laws unlawful and subpoena. Briefly, Congress can pass all laws concerning Guam, with the exception of freedom and living.
And I also share Bevacqua's view that those who are in favour of a state for Guam are dishonest at best. You do not have the fundamental information on the demands on state identity to be part of a serious policy dialogue. Given the present economic crises, nationality is not an optional feature for Guam in the foreseeable future.
Obviously, the Guamese electorate did not vote for any of the Congressional delegates who endorsed the IRS. According to the Spiegel Protocoll, Guam and other areas are not in a position or authorised to amend the personal incomes taxes and thus to eliminate the effects of the Act on reducing taxes on the local revenue in an effective way.
