Decree No. 23 was implemented in July 2009 and is considered to have entered into effect on 10 April 2009. Fijian nationality can be attained through:: All children who have been in Fiji on or after the date of the beginning of Fiji nationality 2009 (10 April 2009) will become Fiji citizens at the time of childbirth, unless one of their parents has ambassadorial privilege and no one is a national.
There are six types of persons for nationality by registration: In the second section, Fiji citizens adopt a child under 18 years of nationality - Section 8 (2) of the Fiji Decree 2009. Thirdly, there is the child under 18 years of age when a parents became Fiji citizens - section 8(3) of the 2009 Nationality Ordinance.
Candidates may only be accorded nationality if they have been legally resident in Fiji for a period of three (3) of the five (5) years immediately preceding the submission of the request - Section 8 (5) of the Fiji Decree 2009. Fifthly, former Fiji adults who want to reclaim their Fiji nationality.
By introducing the multi-state system, former nationals who wish to recover their Fijian nationality do NOT have to relinquish their other nationality - Section 8(6) of the Fiji Decree 2009. Spouse of the Fiji people. Candidates must have legally resided in Fiji for a maximum of three of the five years immediately prior to the filing of the request - Section 8(7) of the Fijian Nationality Decree 2009.
Foreigners may request Fijian nationality if they have been legally resident in Fiji for a period of five (5) of the ten (10) years immediately preceding the filing of the request. By introducing the multi-state visa regime, visa seekers are NOT required to relinquish their other nationality - section 11 (2) of the Fiji Decree 2009 (see below check list for charges and other requirements).
