The Supreme Tribunal, Chief Justice H.P. Wood, found that the accused was authorized to use the name "Lemafa". Aunuuu' s name Lemafa was registered by Sope and the appeal was initially lodged on behalf of Liae, but on the eve of the proceedings Petelo was replaced as the opposition leader and nominee for the name, and this replacement was upheld in a public hearing.
It was Petelo who volunteered his own witness es' report and that of his own witness to back his claim that he was the grandchild of a Lemafa Talagi; that Talagi was the first owner of the name Lemafa; that he, Petelo, had been living in Aunuu for three years as a schoolteacher and had actively served the last owner of the name Seau during this period and less actively served him at other periods.
Sope, on his own candidature, proposed his own and the testimonies of his testimonies that he is the grandchild of Lemafa Taale and a descendant of Lemafa Seau, the sons of the elder von Seau sibling; that he is fifty years old and has always been living in Aunuu and has served Seau personally for more than thirty-one years in the Lemafa household and has been living and still living in the Lemafa family.
Sope, the supporter of the name, has provided the court with a register of six owners of the name Lemafa, starting with Lemafa Aunuu. People called Petelo and his eyewitnesses only four owners of the name, which begins with Lemafa Talagi. Paletua and Seau were the only names on which both sides reached an agreement.
People of Petelo and his testimonies disavowed that there was an owner[1ASR559] titled Taale and Sope, and his testimonies disavowed that there was an owner by the name of Talagi. Peytelo acknowledged that he had never seen his grandpa Talagi, and Sope said that he just recalled seeing Taale when he, Sope, was a little kid.
Eighty-years-old men telephoned as eyewitnesses, attesting, one for Petelo, that he had seen Talag'i and the other appointed by the court as having seen Taale as having seen him. Only Lemafas, of which the court has clear evidence as holders of the titles, are Seau and Paletua.
Both sides recognize Paletua as the owner of the name and Seau was Lemafa from 1906 until his passing in 1936. It is irrelevant whether there was a Lemafa Paletua or not, since none of the nominees in the court is from him.
Paletua's livelihood as owner of the name Lemafa would have been very essential if Liae had stayed a contender. Suppose there was a Lemafa Talagi, then we can suppose that Petelo is his grandchild and if there was a Lemafa Taale, then we can also suppose that Sope is his grandchild.
Anyway, there was without a doubt a Lemafa Seau and Sope is accepted as his sibling. It is this relation between uncles and nephews that is the only evidence of the inheritance laws of the individual candidate in court. If Petelo and Sope are each a grandchild of a Lemafa, their inheritance would be equivalent, unless Sope's relation as Seau's niece is taken into account.
Aunuu has been a schoolteacher for many years and has been living in this position for three years. He spent his whole lifelong existence there and at least during the time of Seau,[1ASR560], was living in Seau's home and serving him as Lemafa. There doesn't seem to be much doubts in the court's response to the fact that Sope had a much better chance to familiarize himself with the country and the general business of the host families than Petelo.
Petelo was in permanent touch with Seau as Lemafa for at least thirty-one years, while Petelo, although true and devoted to his mate, lived in the town for only three years while he worked. In the light of these facts and of all the facts of the case, the Court considers that the Lemafa family's matters would be managed in the best interest of that Sope and not by Petelo, and accordingly the Court's ruling is that the name Lemafa Sope of Aunuu should be given.
